Argumentation involves offering and/or exchanging reasons – either reasons for adopting various attitudes towards specific propositional contents or else reasons for acting in various ways. This paper develops the idea that the force of reasons is through and through a normative force because what good reasons accomplish is precisely to give one a certain sort of entitlement to do what they are reasons for. The paper attempts to shed light on what it is to have a reason, how the sort (...) of entitlement arising from reasons differs from other species of entitlement and how the norms by which such entitlement is assessed obtain their status as norms. Fifty years ago, two Princeton professors established game theory as an important new branch of applied mathematics. Game theory has become a celebrated discipline in its own right, and it npw plays a prestigues role in many disciplines, including ethics, due in particular to the neo-Hobbesian thinking of David Gauthier and others. Now it is perched at the edge of business ethics. I believe that it is dangerous and demeaning. It makes us look the wrong way at business, reinforcing a (...) destructive obsession with measurable outcomes and a false sense of competition. It falsely characterizes or insidiously advocates a style of human behavior that is utterly unacceptable. To put the matter quite crudely, a person who actually practiced the form of "rationality" advocated by game theory would be something of a monster. (shrink)

The Greek philosopher Aristotle, writing over two thousand years before Wall Street, called people who engaged in activities which did not contribute to society "parasites." In his latest work, renowned scholar Robert C. Solomon asserts that though capitalism may require capital, but it does not require, much less should it be defined by the parasites it inevitably attracts. Capitalism has succeeded not with brute strength or because it has made people rich, but because it has produced responsible citizens and--however (...) unevenly--prosperous communities. It cannot tolerate a conception of business that focuses solely on income and vulgarity while ignoring traditional virtues of responsibility, community, and integrity. Many feel that there is too much lip-service and not enough understanding of the importance of cooperation and integrity in corporate life. This book rejects the myths and metaphors of war-like competition that cloud business thinking and develops an "Aristotelean" theory of business. The author's approach emphasizes several core concepts: the corporation as community, the search for excellence, the importance of integrity and sound judgment, as well as a more cooperative and humane vision of business. Solomon stresses the virtues of honesty, trust, fairness, and compassion in the competitive business world, and confronts the problem of "moral mazes" and what he posits as its solution--moral courage. Quons are particles characterized by the parameter q, which permits smooth interpolation between Bose and Fermi statistics; q = 1 gives bosons, q = -1 gives fermions. In this paper we give a heuristic argument for an extension of conservation of statistics to quons with trilinear couplings of the form ffb, where f is fermion-like and b is boson-like. We show that q f 2 = qb. In particular, we relate the bound on qγ for photons to the bound on (...) qe for electrons, allowing the very precise bound for electrons to be carried over to photons. An extension of this argument suggests that all particles are fermions or bosons to a high precision. (shrink)

The past two decades have seen an outpouring of work in legal theory that is self-consciously critical of aspects of American law and the institutions of the liberal state. In this lively volume, eminent scholars in philosophy, law, and political science respond to this recent scholarship by exploring what constitutes a "radical" critique of the law, examining such theories as critical legal studies, feminist theory and theories of "difference," and critical race theory. The authors review the empirical literature in order to assess which variables are postulated as influencing ethical beliefs and decision making. The variables are divided into those unique to the individual decision maker and those considered situational in nature. Variables related to an individual decision maker examined in this review are nationality, religion, sex, age, education, employment, and personality. Situation specific variables examined in this review are referent groups, rewards and sanctions, codes of conduct, type of ethical conflict, organization effects, (...) industry, and business competitiveness. The review identifies the variables that have been empirically tested in an effort to uncover what is known and what we need to know about the variables that are hypothesized as determinants of ethical decision behavior. The concept of contextual emergence is proposed as a non-reductive, yet welldefined relation between different levels of description of physical and other systems. It is illustrated for the transition from statistical mechanics to thermodynamical properties such as temperature. Stability conditions are crucial for a rigorous implementation of contingent contexts that are required to understand temperature as an emergent property. It is proposed that such stability conditions are meaningful for contextual emergence beyond physics as well.

The mutual influence of science and values in biology is exhibited in several cases from the biological literature. It is argued in a number of cases, from R. A. Fisher's argument for the optimality of a 50:50 sex ratio to A. Jensen's defense of a genetic basis for intelligence, and including work on the evolution of sexual dimorphism and muted aggression, that the credence accorded the views is disproportionate with their theoretical and empirical warrant. It is, furthermore, suggested that the (...) proper explanation for the attraction and persistence of such views lies in their conformity with ideological norms. There is thus an important, if circumscribed, role for ideological critique in the evaluation of scientific theories; in particular, it lies in the explanation of the acceptance and persistence of scientific views, given independent grounds for questioning their justifiability. Developmental biology has resurfaced in recent years, often without a clearly central role for the organism. The organism is pulled in divergent directions: on the one hand, there is an important body of work that emphasizes the role of the gene in development, as executing and controlling embryological change; on the other hand, there are more theoretical approaches under which the organism disappears as little more than an instance for testing biological generalizations. I press here for the ineliminability of the (...) organism in developmental biology on explanatory grounds. I examine classical work concerned with growth and development, particularly in Drosophila and C. elegans. Some of this work is suggestive of modular development, and accordingly suggests a level below that of the organism as being explanatory. These are not the only type of case. There are other equally well-established results, which indicate greater integration in the developing organism. Though with a modular organization the organism can be thought of as made up of its constituent traits, and though the explanations of these traits may lie in terms of cells or genes, even with modular development the explanations of "genetic" differences require an appeal to the organism. With non-modular organization the organism has an even more central role. This does not mean that these genetic or cellular contributions are unreal in any way, or that development requires some sort of vitalistic contribution; but the genetic contributions make sense only as constituents of the organism, embedded in a larger organic context. Proponents of the dominant paradigm in evolutionary psychology argue that a viable evolutionary cognitive psychology requires that specific cognitive capacities be heritable and “quasi-independent” from other heritable traits, and that these requirements are best satisfied by innate cognitive modules. We argue here that neither of these are required in order to describe and explain how evolution shaped the mind.

The classic charge against Freudian theory is that the therapeutic success of psychoanalysis can be explained without appeal to the mechanisms of repression and insight. Whatever therapeutic success psychoanalysis might enjoy would then provide no support for the diagnostic claim that psychological disorders are due to repressed desires or for the therapeutic claim that the gains in psychoanalysis are due to insight into repressed causes. Adolf Grünbaum has repeated the charge in The Foundations of Psychoanalysis (1984), arguing that Freud's response (...) to it in what he calls the "Tally Argument" is woefully inadequate. Grünbaum claims that Freud's defense depends on the view that only psychoanalytic techniques can yield therapeutic effects, and therefore that the transience of some psychoanalytic "cures", the existence of alternative treatment modalities, and the frequency of spontaneous remission undermine Freud's defense of psychoanalysis. I argue that, whatever the merits of psychoanalysis, Freud is not logically committed to any view as extreme as that attributed to him by Grünbaum; and, furthermore, Grünbaum's rendering of Freud is historically inaccurate. Kellert (In the Wake of Chars, University of Chicago press, Chicago, 1993) has argued that Laplacean determinism in classical physics is actually a layered concept, where various properties or layers composing this form of determinism can be peeled away. Here, I argue that a layered conception of determinism is inappropriate and that we should think in terms of different deterministic models applicable to different kinds of systems. The upshot of this analysis is that the notion of state is more closely (...) tied to the kind of system being investigated than is usually considered in discussions of determinism. So when investigating determinism corresponding changes to the appropriate notion of state – and, perhaps, the state space itself – also need to be considered. (shrink)

B cell activation is accompanied by metabolic adaptations to meet the increased energetic demands of proliferation. The metabolic composition of the microenvironment is known to change during a germinal center response, in inflamed tissue and to vary significantly between different organs. To sustain cellular homeostasis B cells need to be able to dynamically adapt to changes in their environment. An inability to take up and process available nutrients can result in impaired B cell growth and a diminished humoral immune response. (...) Furthermore, the metabolic microenvironment can affect B cell signaling and provide a means to avoid aberrant proliferation or modulate B cell function. Thus, a better understanding of the intricate interplay between cell signaling and metabolism could provide novel insight into how B cell function is regulated and have implications for the development of vaccines or treatment of autoimmune disorders and B cell derived malignancies. Throughout their lifespan, B cells are exposed to different metabolic environments. Signaling pathways regulating cellular responses to metabolic stress not only help to maintain B cell viability and to facilitate cellular functions but may also play an important role in preventing excessive proliferation and malignant transformation. Cloth, $60.00.Focusing on the relatively neglected fifth chapter of Being and Time's Division Two (BT, Sections 72-77), Fritsche argues that BT is an essentially political work. Even Victor Farías, although he talks of "shared attitudes" (...) and "implicit direction," settles for the conclusion that "in no sense can we read National Socialism into Being and Time, but we can identify philosophical beliefs that foreshadow Heidegger's later conviction."(Victor Farías, Heidegger and Nazism, trans. Paul Burrell and Gabriel R. Ricci [Philadelphia: Temple University Press, 1989], 60.) Fritsche, however, evidently intends to out-Farías Farías. For him, BT just is "a brilliant summary of the politics of the revolutionary Right" (xii; cf., xv, 216).Following Tom Rockmore, Fritsche insists that by grounding ontological inquiry in a distinction between authentic and inauthentic existence, Heidegger is "committed" to "a political understanding of human being" that "culminates" in the analysis of authentic historicity in Section 74 (29). According to Fritsche, BT proceeds, "in conventional metaphysical fashion," to work out a "hierarchical" presentation of the structures and activities of our existence as a "drama in three acts." The first act is Heidegger's analysis of the conflicted, inauthentic, "downward plunging" condition of everyday life. In act two, there arises out of this condition a "crisis" (of conscience) that calls for a "dramatic solution." The third act "consists in authentic Dasein stepping out of the world in which it has been living as ordinary Dasein, turning back to this world, and canceling it... in order to rerealize the past" (x, 29-30).Fritsche plays BT off primarily against three sources, Richard Wolin's Politics of Being (1990), articles by Peg Birmingham (1991), and Charles Guignon (1992), in order to distance BT from "decisionist," "anarchist," and "politically neutral" interpretations, respectively. Like this selection of foils, Fritsche's comparison of texts often seems merely convenient. In general, if two people use the same term, they probably mean the same thing; and key concepts are typically assumed to have uniform definitions. Hence, if Scheler speaks of a hierarchy of values and Hitler, of a hierarchy of races, they must be employing "the same logic" (108-9). And because vorlaufen [anticipating/running ahead] was the term used by right wing German authors to mythologize the gallant but foolish young "heroes of Langemarck" who "stepped out of their trenches, into the open," and "ran toward" French lines, one should also employ this image a "methodological ideal type to interpret Heidegger's concept of resoluteness" (3, 196, 233). Finally, Fritsche makes no systematic distinction between what an author has once said and what either we or the author might later make of it. Hence, if Heidegger says in 1933 that he is drawing on BT for political purposes, he must have had these purposes in mind when writing it ten years earlier (216ff.). And obviously, choosing "Volksgemeinschaft" to talk of community in BT's Section 74 already unmistakably reveals "Heidegger's option for National Socialism" (217-18).One need carry no brief for an apolitical Heidegger to see that Fritsche's reading is problematic on several levels. Heidegger's own account of BT's purpose and method is ignored rather than challenged. Numerous Heideggerian notions are construed, without [End Page 455] argument, as "really" being just right-wing political or "conventional metaphysical" usage. Moreover, categories of Left and Right are sometimes handled so loosely that, for example, Scheler writing in 1913, Heidegger writing in 1921-24, and Hitler in Mein Kampf, all must "belong" to the revolutionary Right, because they all privilege traditional Gemeinschaft over modern Gesellschaft. By the same reasoning, Heidegger's concept of historicity is "identical" to Scheler's and Hitler's. This has to be right because "Heidegger's text is just too excellent a summary of the revolutionary rightist notion to be the result of a somnambulistic thinking" (136). Human beings, like other organisms, are the products of evolution. Like other organisms, we exhibit traits that are the product of natural selection. Our psychological capacities are evolved traits as much as are our gait and posture. This much few would dispute. Evolutionary psychology goes further than this, claiming that our psychological traits -- including a wide variety of traits, from mate preference and jealousy to language and reason -- can be understood as specific adaptations to ancestral Pleistocene conditions. In (...) Evolutionary Psychology as Maladapted Psychology, Robert Richardson takes a critical look at evolutionary psychology by subjecting its ambitious and controversial claims to the same sorts of methodological and evidential constraints that are broadly accepted within evolutionary biology. The claims of evolutionary psychology may pass muster as psychology; but what are their evolutionary credentials? Richardson considers three ways adaptive hypotheses can be evaluated, using examples from the biological literature to illustrate what sorts of evidence and methodology would be necessary to establish specific evolutionary and adaptive explanations of human psychological traits. He shows that existing explanations within evolutionary psychology fall woefully short of accepted biological standards. The theories offered by evolutionary psychologists may identify traits that are, or were, beneficial to humans. But gauged by biological standards, there is inadequate evidence: evolutionary psychologists are largely silent on the evolutionary evidence relevant to assessing their claims, including such matters as variation in ancestral populations, heritability, and the advantage offered to our ancestors. As evolutionary claims they are unsubstantiated. Evolutionary psychology, Richardson concludes, may offer a program of research, but it lacks the kind of evidence that is generally expected within evolutionary biology. In this wide-ranging philosophical work, Koons takes on two powerful dogmas--anti-realism and materialism.

This paper challenges the view that arguments are (by definition, as it were) attempts to persuade or convince an audience to accept (or reject) a point of view by presenting reasons for (or against) that point of view. I maintain, first, that an arguer need not intend any effect beyond that of making it manifest to readers or hearers that there is a reason for doing some particular thing (e.g., for believing a certain proposition, or alternatively for rejecting it), and (...) second that when an arguer is in fact trying to induce an effect above and beyond rendering a reason manifest, the effect intended—the use to which his or her argument is put—need not be that hearers do what the stated reasons are reasons for doing. Where the actual or intended effect of making a reason R for doing X manifest is something other than doing X, I call it an oblique—as opposed to a direct—effect of making that reason manifest. The core of the paper presents an overview or map of the main categories of effect which arguments can have, and the main sub-types within each category, calling attention to the points at which such effects can be indirect or oblique effects. The purpose of that typology is to make it clear (i) how oblique effects can come about and (ii) how important a role they can play in the conduct of argumentation. (shrink)
